What Is a Guardian ad Litem?

A Guardian ad Litem (“GAL”) is an attorney appointed by the Court to protect the best interests of a child in a family law proceeding. Unlike the attorneys representing the parents, the GAL does not represent either party — the GAL’s only client is the child.

Under Oklahoma law, a GAL is an officer of the Court, charged with protecting the child’s rights on behalf of the State. The GAL investigates, gathers information, and presents objective findings and recommendations to the Court.

A GAL is not a therapist, a parent’s advocate, or a judge. The GAL’s role is to gather facts from all available sources and present an objective recommendation — one that carries significant weight in the judge’s final decision.

GAL appointments are common in contested custody matters, cases involving allegations of abuse or neglect, significant parental conflict, or where the Court needs an independent assessment of what environment will best serve the child.
